These Terms and Conditions (“Terms”) govern your access to and use of the XRayAI platform, including its website, mobile applications, dashboards, software, APIs, and related services (collectively, the “Service”), operated by TruVera Solutions LLC (“Company”, “we”, “us”, or “our”).

By accessing, registering for, or using XRayAI, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Description of Service

XRayAI is an AI-powered financial analysis and transparency platform designed to:

  • Provide accurate and complete registration information

We reserve the right to suspend or terminate accounts that violate these requirements.

3. No Professional Advice Disclaimer

All insights, reports, savings estimates, and recommendations provided by XRayAI are:

  • Informational and educational only
  • Generated using automated algorithms and AI models
  • Based on data uploaded or provided by users

XRayAI does not guarantee accuracy, completeness, or financial outcomes, and you acknowledge that:

  • Actual savings may vary
  • Decisions made using the Service are at your own risk
  • You should consult licensed professionals before acting on results

4. User Responsibilities

You agree to:

  • Upload only data you own or are authorized to use
  • Ensure accuracy of information submitted
  • Use the Service in compliance with applicable laws
  • Maintain confidentiality of your login credentials

You may not:

  • Reverse engineer, scrape, or exploit the platform
  • Use XRayAI for fraudulent or deceptive purposes
  • Upload malicious files or false documents

5. AI Limitations & Acknowledgment

You acknowledge and accept that:

  • AI-generated outputs may contain errors, omissions, or inaccuracies
  • Results are probabilistic, not deterministic
  • The Service evolves and may change without notice

You agree that XRayAI is a decision-support tool, not a replacement for human judgment.

6. Subscriptions, Billing & Trials

a. Subscription Plans

Certain features require a paid subscription. Pricing, features, and billing cycles are disclosed at checkout.

b. Free Trials

If a free trial is offered:

  • Billing begins automatically at the end of the trial
  • You must cancel before the trial ends to avoid charges

c. Payments

Payments are processed through third-party providers (e.g., Stripe, Apple App Store, Google Play, or authorized processors). We do not store your payment credentials.

d. Refund Policy

All fees are non-refundable, except where required by law or platform policy.

7. Partner / ISO Accounts

If you register as a Partner:

  • You acknowledge that XRayAI does not guarantee merchant conversions or revenue
  • You are responsible for compliance with all applicable industry regulations
  • You may not misrepresent XRayAI as a financial institution or guarantee outcomes

8. Data Ownership & Privacy

  • You retain ownership of your uploaded data
  • You grant XRayAI a license to process data solely to provide the Service
  • Data handling is governed by our Privacy Policy

We implement reasonable security measures but cannot guarantee absolute security.

9. Intellectual Property

All content, software, branding, algorithms, and trademarks associated with XRayAI are the exclusive property of TruVera Solutions LLC.

You may not copy, modify, distribute, or create derivative works without written permission.

10. Third-Party Services

XRayAI may integrate with or reference third-party services. We are not responsible for:

  • Their availability
  • Accuracy
  • Security or data practices

Use of third-party services is at your own risk.

11. Suspension & Termination

We may suspend or terminate access if you:

  • Violate these Terms
  • Engage in misuse or abuse
  • Pose legal, security, or reputational risk

Upon termination, your right to use the Service immediately ceases.

12. Limitation of Liability

To the maximum extent permitted by law:

  • XRayAI and TruVera Solutions LLC shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid by you in the prior 12 months

13. Indemnification

You agree to indemnify and hold harmless XRayAI and TruVera Solutions LLC from any claims arising from:

  • Your use of the Service
  • Uploaded data
  • Violation of these Terms or applicable laws

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance.
